By accessing or using FenoGent, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to any of these terms, you must not use our services. These terms are governed by the Turkish Code of Obligations (Law No. 6098) and the Consumer Protection Law (Law No. 6502) where applicable.

Service Description

FenoGent is a SaaS (Software as a Service) YouTube analytics platform that helps content creators analyze their channel performance, track trends, and generate content ideas using AI. The service is provided as a digital content/service accessible via web browser.

Account Responsibilities

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality and security of your account credentials
• You must not share, transfer, or sell your account to any third party
• You must be at least 18 years old, or at least 13 years old with verifiable parental/guardian consent
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Subscription & Payments

• Paid plans are billed monthly in advance on a recurring basis
• All prices are displayed inclusive of applicable taxes (VAT/KDV)
• All payments are processed securely through Paddle, which acts as Merchant of Record handling taxes and invoicing
• You may upgrade or downgrade your plan at any time; changes take effect at the next billing cycle
• Free trial periods (where offered) do not require payment information and convert to the free plan upon expiration unless you choose to upgrade
• We reserve the right to modify pricing with 30 days' advance notice to existing subscribers

Cancellation & Right of Withdrawal

You may cancel your subscription at any time. Upon cancellation, your paid features remain active until the end of the current billing period. As a digital service delivered immediately upon purchase, the 14-day right of withdrawal under the Distance Contracts Regulation may not apply once the service has been fully provided. Acceptable Use

• Use the service only for lawful purposes in compliance with applicable laws
• Do not attempt to reverse engineer, decompile, or hack the platform
• Do not use automated bots, scrapers, or tools to overload our servers or extract data
• Do not use the service to infringe upon the intellectual property rights of others
• Respect YouTube's Terms of Service and API Terms when using our platform
• Do not resell, sublicense, or redistribute access to the service

Intellectual Property

All content, features, designs, algorithms, and technology comprising FenoGent are owned by FenoGent and protected under Turkish Intellectual Property Law (Law No. 5846) and international copyright treaties. Your subscription grants you a limited, non-exclusive, non-transferable license to use the service. Your YouTube channel data remains your property; we claim no ownership over it.

Limitation of Liability

FenoGent is provided "as is" and "as available." To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim. This limitation does not affect your statutory rights under mandatory consumer protection laws.

Changes to Terms

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the Istanbul Courts and Consumer Arbitration Committees (Tüketici Hakem Heyetleri), as applicable under Law No. 6502. For EU users, this does not affect your right to bring proceedings in your local courts under applicable consumer protection legislation.
